II- Purchase conditions

The products and services offered on the site are reserved for adults (or minors holding an authorization from their legal representative allowing them to place an order through the site) and having full legal capacity to place orders. on the site. Mademoiselle Saint Germain reserves the right at any time to request proof of identity attesting to the age of the client and / or the authorization of the aforementioned legal representative. The company reserves the right not to respond to an order and / or to exclude from its customer / prospect database, a buyer who has not responded to the above request or who has not complied with the principles enacted in this clause.

It is specified that the products are intended for the personal use of the purchaser, without any direct connection with the professional activity of the latter. As such, the attention of the buyer is particularly drawn to the fact that the amount of his orders must not exceed the sum of € 500 per order. In addition, it is specified that the same buyer can only order a maximum of 5 products of the same reference, excluding sample products and gifts, per order.

Finally, the same buyer can only place two orders per day. In the event of an order greater than the aforementioned amount and / or the aforementioned number, the order will be considered void.

These general conditions of sale govern all sales and in general all relations between SAS Mademoiselle Saint Germain and its customers.
These general conditions of sale will prevail over all other conditions appearing in any other document.
Mademoiselle Saint Germain reserves the right to modify the general conditions of sale at any time. The conditions of sale in force are those of the day of validation of the order.
Any order for a product implies consultation and express acceptance of the GTC, without however this acceptance being conditioned by a handwritten signature from the customer.

III- Price

The prices of the products are indicated in euros all taxes included.
All orders regardless of their origin are payable in euros.
Mademoiselle Saint Germain reserves the right to modify its prices at any time.
The products will be invoiced on the basis of the prices in effect at the time the order is placed.

The selling price of the products does not include shipping costs invoiced in addition to the price and amount per order to the amount indicated below:

  • Mondial Relay: 4.90 euro including tax / order
  • Colissimo – without signature: 4.90 euro including tax / order
  • Colissimo – with signature: 5.90 euro including tax / order
  • International shipping: 7.90 euro including tax / order

The additional costs of transport, delivery or postage (to which must be added any other costs borne by the seller), which the customer may have taken note of before ordering, are fixed on the order form.

IV- Terms of the order

To enter an order, the buyer must first connect to the website.
While browsing the site, the buyer wishing to place an order can do so by simply clicking on the button intended to add the product to the shopping cart.
As soon as this is done, the buyer will see the number of products in his basket displayed. The buyer can continue his visit or click on his shopping cart to see the contents of his basket displayed on the screen, showing all the elements of the order and in particular the essential characteristics of the products, the total amount of the ordered. The buyer can go back to his basket, complete it, modify it, cancel it as long as he has not validated it.

Once the selection of products is complete, the buyer can order them by validating the order using the button provided for this purpose. Therefore, a new page opens inviting the buyer to either:

  • Enter their username (email address) and password if the buyer is already registered on the site,
  • Accurately complete a personal data collection form by filling in the required fields, in particular Name, First name, E-mail address, Billing postal address, Delivery postal address (address to which delivery can be made during working hours Monday to Friday in France).

The Purchaser undertakes to complete the form made available to him in good faith. The Buyer acknowledges that the data he communicates to the Seller and which is stored in the information systems of the Seller and / or its subcontractors are accurate and constitute proof of his identity. It is recalled that this personal data is governed by the Personal Data Policy accessible in paragraph XVII of these T & Cs.

After checking the content of his order, the buyer is invited to click on the button to access payment for his order, under the conditions described in these GTC.

Clicking on the “Order” button after entering delivery and billing information constitutes an electronic signature which has the same value as a handwritten signature. Clicking on the “Order” button constitutes acceptance of the general conditions of sale and constitutes irrevocable and unreserved acceptance of the order by the buyer.

V- Order confirmation

An electronic message is sent and confirms the acceptance of his order to the purchaser at the email address that the latter will have communicated. The sale will only be concluded after the written confirmation of the order by Mademoiselle Saint Germain.

Mademoiselle Saint Germain is not bound by any offers to sell that she may have made in relation to products held in stock if these products have been sold between the time when the company has established its offers to sell and the time when it has accepted customer orders.

Mademoiselle Saint Germain reserves the right to refuse any order from a customer with whom there is a dispute over payment for a previous order.
Mademoiselle Saint Germain reserves the right not to accept an order for reasons of stock shortage or payment authorization.

The information provided by the customer when ordering is binding. In the event of an error in the wording of the recipient’s contact details, Mademoiselle Saint Germain cannot be held responsible for the impossibility in which it may be to deliver the product.

VI- Payment

The amount owed by the buyer is the amount indicated on the order confirmation as displayed on the dedicated web page for this purpose and then sent by email by the seller to the buyer.
The buyer will have the choice during the validation of his order as specified above, between different payment methods. Payment is made online by valid Credit Card (Visa, Amex, Mastercard) or via Paypal.

VII – Delivery

VII.1. Shipping conditions

Once the order has been prepared, it is sent to the postal address provided by the buyer when ordering.
The products are delivered by the postal services or by a specialized provider (depending on the case and / or the delivery options selected by the buyer) or directly collected by the buyer from the listed outlets.

  • Mondial Relay: the buyer must present an identity document to the merchant against delivery of the package. The buyer then validates receipt of it by electronic signature. The merchant will keep the package available for fourteen (14) days. After this period, the package will be returned to the sender.
  • Colissimo – without signature: if the buyer is absent, the carrier leaves a transit advice note in the buyer’s letterbox. The buyer must then get in touch with the carrier to agree on a new delivery date. It is nevertheless specified that if the buyer does not contact the carrier again, the latter carries out two new delivery tests, the date and time of which will be determined at the discretion of the carrier. The package is kept by the delivery person for a period of ten (15) days after the first presentation.
  • Colissimo – with signature: delivery of the package to the address indicated by the sender against the signature of the recipient or that of any person attached to his service or living with him or by any other delivery method agreed between La Poste and the recipient. In their absence, a notice of pending indicating the coordinates of the site where to collect the package will be placed in the letter box.
  • Withdrawal from head office: delivery charges are free in the event of withdrawal from the company’s head office. This withdrawal is made by appointment only.

VII.2. Delivery time

Orders are processed within a maximum of twenty-four working hours (24 hours).

It is reminded that an order is only sent once it has been processed and payment has been confirmed.
From the processing of the order, subject to the delivery terms above, the corresponding products are routed and delivered by the carrier within the following deadlines:

  • Mondial Relay: 72h (three (3) working days)
  • Colissimo – without signature: 24h to 48h (one (1) to two (2) working days)
  • Colissimo – with signature: 24h to 48h (one (1) to two (2) working days)
  • International shipping: 48h to 7 working days depending on the country

Sundays and public holidays are not considered to be working days.

In any case, the order is executed within a maximum period of thirty (30) days from the day following that on which the buyer has validated his order, subject to full payment of the price and compliance with the purchase conditions. .
In the absence of delivery at the end of this period, the buyer has the option of canceling his order in accordance with the terms set out in these General Terms and Conditions of Sale.

VII.3. Obligations

Mademoiselle Saint Germain is released from the obligation to deliver and more generally from her obligations and cannot be held responsible for delays in delivery or for direct and / or indirect damage resulting therefrom as a result of the occurrence of any fortuitous event or of force majeure, such as social disorders, accidents, the impossibility of being supplied by its suppliers, acts of any third party including the customer or any other circumstance having an external cause which directly prevents it from meeting its obligation. Mademoiselle Saint Germain cannot be held responsible for non-compliance by her suppliers with their obligations towards her.

VII.4. Delivery issues

The customer is required to check his package on arrival. He must notify La Poste and Mademoiselle Saint Germain of all reservations about the delivered product (for example: damaged package, already open, etc.). The request must be made within 7 days of delivery. Any complaint made after this deadline cannot be accepted.

Mademoiselle Saint Germain undertakes to reimburse the customer or to exchange products that do not correspond to the order.

Mademoiselle Saint Germain will exchange or refund the product (s) after receipt of the products previously delivered with a description of the problems.
Products must be returned in the condition in which the customer received them. A product that has been used and then returned within the time limit will not be eligible for a refund.

Shipping costs will be reimbursed on the basis of the invoiced rate. Return costs are the responsibility of the buyer.
In any event, the customer benefits from the provisions of the legal guarantee, in particular those relating to the guarantee against hidden defects.

The provisions of this article do not prevent the customer from benefiting from the right of withdrawal.

VII.5. Availability

Product offers are valid while stocks last. In case of unavailability of a product after placing the order, the customer is informed by email.

VIII- Right of withdrawal

VIII.1. Notification to the seller of the withdrawal decision

In accordance with the provisions of article L.222-7 of the Consumer Code, the customer has a legal withdrawal period allowing him to return to Mademoiselle Saint Germain all or part of the products that were the subject of his order. and this for a period of 14 clear days from the date of receipt of the products, without it being necessary to indicate the reason. VIII.2. Return of products subject to withdrawal

VIII.3. Reimbursement of products subject to withdrawal

The seller agrees to reimburse the buyer for all sums paid, including delivery costs
(with the exception of additional delivery costs resulting from the fact that the buyer has chosen, where applicable, a delivery method other than the less expensive standard delivery method offered by the seller). Unless the buyer expressly agrees for another means of reimbursement, the reimbursement of the product (s) is made according to the method of payment

IX- Retention of title clause

The products sold remain the property of Mademoiselle Saint Germain until full payment of the price by the customer, in accordance with the provisions of Law No. 80-335 of May 12, 1980 and all subsequent texts. However, the risks are transferred upon delivery.

In the event of non-payment by the due date by the customer, Mademoiselle Saint Germain may, without losing any of her rights, demand by registered letter with acknowledgment of receipt, the return at the customer’s expense and risk of the products and goods sold.
Consequently, the customer will be required to take all necessary measures so that the products sold remain, until full payment of the price, identifiable as the property of Mademoiselle Saint Germain.

Thus, the order made by the customer will not be considered effective until the bank payment centers concerned have given their agreement. In case of refusal of payment from said centers, the order will be automatically canceled. The customer will be notified by email.

X- Legal guarantees

X.1. Description of legal guarantees

In accordance with Articles L. 217-4 et seq. Of the Consumer Code, the seller is required to deliver a product in accordance with the order made by the buyer and must respond to any lack of conformity existing at the time of the

In addition to the legal guarantee against hidden defects, the legal guarantee of eviction (Art. 1625 et seq. Of the Civil Code), the products sold benefit from a manufacturer’s guarantee, the duration of which is indicated in the instructions for each product.
These guarantees are exclusive of any other guarantee of result as to the satisfaction of the specific needs of the customer.

X.2. Process to follow

X.3. Content of legal guarantees

    The costs and risks of the return are always the responsibility of the customer.
    No return will be accepted after a period of 15 days following the delivery date.
  • In the event of an apparent defect or non-conformity of the products delivered, duly noted by Mademoiselle Saint Germain under the conditions provided for in the above clause, the customer may obtain the free replacement or reimbursement of such products, at the choice of Mademoiselle Saint Germain , to the exclusion of any compensation or damages.
  • Product refunds will be made at our expense within a period of less than or equal to 15 days after receipt of the products by us.

XIV- Cancellation clause and penalty clause
